- Prize Details: One (1) winner (the “Player”) will win the opportunity to play a ‘lucky envelope’ game to determine the final value of their prize. Of the 100 envelopes, one (1) contains an item representing the major prize (AUD $100,000), the other 99 envelopes each contain an item representing the minor prize, (AUD $10,000).
-
Minor Prize: The $10,000 minor prize will be provided to the Player in the form of two (2) EFTPOS cards, each pre-loaded with $5,000. These will be provided to the Player within 7 days of the ‘Lucky Envelope’ draw.
-
Major Prize: The $100,000 major prize will be provided to the Player in the form of a cheque or bank transfer, within 28 working days from the ‘Lucky Envelope’ draw.
-
In order to claim either the Minor or Major prize, the Player must provide contact details (Name, Address, Contact Number) and relevant account details for the chosen method of receiving the major prize at the time of the ‘Lucky Envelope’ Draw.
-
In addition to the Player, a representative from the retail partner (the “Retailer”) where the Player bought the winning product from, will be invited to take part in the same ‘Lucky Envelope’ draw, after the Player has selected an envelope.
- The Process for the Lucky Envelope Prize Draw (the “Game”):
-
The Game will take place on 28 May 2012. The location of the Game will be advised at the time of advising the Winner of the draw result. If the winner resides in Australia, the Game will be held at D-Link Australia, Building A, 11 Talavera Rd, North Ryde, NSW Australia. If the winner resides in New Zealand, then the Game will be held at D-Link New Zealand, Level 3, 60 Cook Street, Auckland, New Zealand.
- The Game will include two participants, the Player and the Retailer. There is only one (1) envelope that contains the Major Prize – all other envelopes contain the Minor Prize.
- The Player will have the first guess in the Game. The Player will be asked to choose one (1) object from 100 objects on display. Each object has a unique number corresponding to the 100 sealed envelopes containing the prize details. Once the Player selects an object, the envelope corresponding to the number is opened and the value of the prize won is revealed. The first choice is final, and only one envelope will be opened for the choice of the Player.
- If the Player chooses the envelope with the Major Prize, the Retailer will not get to play the Game. In that instance the Retailer will win the Minor Prize without having to choose an object. If however, the Player chooses an envelope with the Minor Prize, then the Retailer will then play the Game with the remaining 99 objects. If the Retailer also chooses an envelope with the Minor Prize, then the administrator of the Game will open the master envelope and reveal the number of the lucky envelope with the Major Prize. The Player will then be invited to open the Envelope and confirm that it contained the Major Prize.
- The maximum prize pool is up to AUD$114,000 inc. GST. The Promoter accepts no responsibility for any variation of the value of the prize. If the prize winner does not accept the prize, the prize will be forfeited. Proof of identification, age and residence may be required in order to claim a prize. In the case of the Retailer, the prize will be awarded to the retail organization, not the individual representative that played the Game.
- The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prize is not transferable to another person or exchangeable for other goods and services and cannot be redeemed as cash, other goods and services or sold to a third party. Prizes that are unused will be forfeited and no compensation will be paid in lieu of that element of the prize.
- The Promoter will provide transfers (hire car/taxis), flights (economy), meal allowances, accommodation (standard room) for one night, and transfers to and from the Game location for just the Player (up to the value of $2,000) and the Retailer (up to the value of $2,000). The travel and transfers are for two people in total – the Player and the Retailer valued up to a maximum total of $4,000. Other non-essential travel or costs instigated by the Player or Retailer; including but not limited to, room service, in-room purchases, flight upgrades and other incidental costs are the individual responsibility of the Player or the Retailer.
- If the Winner is unable to attend the Game, they are authorised to appoint a Proxy to take their place at the Game. The Proxy will serve as the Player, with the prize to go to the Winner. If the Winner is unable to provide a Proxy to attend the game, the Promoter will appoint a Proxy on their behalf. If that occurs, the promoter must then notify the winner of their prize in writing & publish their details to make all reasonable attempts to contact the winner
- The Promoter reserves the right to substitute a Prize with a substitute Prize of equal or greater value and the Prize Winner will be notified accordingly subject to state regulations.
- The Promoter, and their related bodies corporate and their respective officers, employees, contractors and agents, will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) which is suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law.
- If for any reason the promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.
- Prize winners must, on request by the Promoter, be able to provide evidence which, to the reasonable satisfaction of the Promoter, demonstrates that the winner is an Eligible Entrant and has complied with these Terms and Conditions.
- Entry details remain the property of the Promoter. The name of the winner may be used for promotional purposes by the Promoter, unless a winner otherwise notifies the Promoter at the time of accepting their prize. Eligible Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes.
